These Terms of Service ("Terms") govern your access to and use of the ClipIt mobile application and related services (the "Service") provided by ClipIt ("ClipIt," "we," "us," or "our"). Please read these Terms carefully before using the Service.
By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use ClipIt. If you are under the age of majority in your jurisdiction, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms on your behalf.
2. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Provide accurate account information and notify us promptly at hello@clipit.coach if you suspect unauthorized access.
You may delete your account at any time from within the app. See our Delete Account page for instructions.
3. The Service
ClipIt enables users to share short sports video clips and exchange feedback through timestamped comments, drawings, voice notes, and direct messages. Features may change over time as we improve the product.
We may modify, suspend, or discontinue any part of the Service at any time. We will make reasonable efforts to provide notice of material changes when practical.
4. Your Content
You retain ownership of the videos, messages, comments, drawings, voice notes, and other content you submit through the Service ("User Content").
By submitting User Content, you grant ClipIt a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content solely to operate and provide the Service — including delivering clips and feedback to the conversations and recipients you select.
You represent and warrant that:
- You own or have the necessary rights to your User Content
- Your User Content does not violate these Terms or applicable law
- You have obtained any required permissions from people shown in your videos, including athletes, minors, teams, and organizations
5. Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes
- Harass, threaten, or impersonate others
- Upload content that is illegal, infringing, or exploitative
- Attempt to access accounts or data that are not yours
- Interfere with or disrupt the Service or its security
- Reverse engineer or misuse the app except as permitted by law
We may investigate violations and remove content or suspend accounts when we reasonably believe these Terms have been breached.
6. Privacy
Our Privacy Policy explains how we collect, use, and protect information. By using the Service, you consent to those practices.
7. Third-Party Services
The Service may rely on third-party infrastructure for hosting, storage, notifications, and analytics. Your use of those underlying services may be subject to their own terms and policies.
8. Intellectual Property
ClipIt and its logos, branding, software, and design elements are owned by ClipIt or its licensors and are protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CLIPIT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
ClipIt is a communication and review tool. We do not provide coaching, medical, or professional sports advice, and feedback from other users does not represent ClipIt's views.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLIPIT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100), IF YOU USE A FREE VERSION OF THE SERVICE.
11. Indemnification
You agree to defend, indemnify, and hold harmless ClipIt from claims, damages, losses, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms.
12. Termination
You may stop using the Service at any time and may delete your account from within the app. We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses risk to the Service or other users.
13. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where ClipIt operates, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless otherwise required by applicable consumer protection law.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
